Terms of Use

Shot:DNA is a tap-first basketball practice-scoring app. You score your shots hands-free with Bluetooth-earbud taps (AirPods, Pixel Buds, etc.) or with on-screen buttons. The current product has no microphone access, no voice recording, no camera capture, no video upload, and no pose analysis. These Terms are the agreement between you and Andrei Dziarkach (sole proprietor) for using the app at shotdna.app. By creating an account or using the app you agree to them and to our Privacy Policy.

You need to be at least 13 (16 in the EEA/UK without verifiable parental consent). Players under that age can still use Shot:DNA by asking a parent or guardian to approve the account via the consent link we email them. You agree to give accurate sign-up info and to keep your password to yourself. If an account is supervised by a parent, the parent is responsible for activity on the account.

Shot:DNA does not capture audio, video, or pose data. Use the app for your own basketball practice tracking and don't try to repurpose it for surveillance, identification, or anything that would invade another person's privacy.

You also agree not to:

• Reverse engineer, scrape, or otherwise extract data from the app beyond what the interface offers.
• Try to break, overload, or probe the service.
• Use the app to harass anyone or to infringe anyone's rights.
• Game leaderboards or rewards through automation, multi-accounting, or fake input.
• Use the app for any illegal purpose.

We can suspend or terminate accounts that violate these rules.

You own the things you provide: your display name and avatar. You give us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, and display that content solely to run the service for you and to sync it to your own other devices. We do not share it with anyone outside the sub-processors listed in the Privacy Policy.

We never receive audio, video, photos, or pose data — there is nothing else to license.

Shot Mode is free forever. Mission and the other Pro features require a paid plan. Today we offer:

• Pro Monthly — $3.99 per month, auto-renewing.
• Pro Annual — $34 per year, auto-renewing.
• Founder lifetime — $49 one time, limited to 500 seats, no renewal.

Eligible new accounts get a 7-day free trial. Unless you cancel before it ends, the trial converts into a paid subscription at the plan price. Subscriptions renew automatically each period until you cancel. You can cancel any time from Settings or the Stripe billing portal; your access continues until the end of the period you already paid for.

All prices are in US dollars and exclude any taxes Stripe collects for your region. Payments are processed by Stripe — we never see or store your card number. If we change a price, we'll tell you before it applies to your next renewal.

Coaches can buy credit packs — $1.99 for 50 credits, $5.99 for 200, $24.99 for 1000 — which pay for AI voice and image generation inside Coach Hub. Credits are prepaid, have no cash value, are not transferable between accounts, and are not refundable except where the law requires it. Any remaining balance is removed when the account is deleted.

The Founder lifetime pass and credit packs are digital content delivered immediately after purchase. Consumers in the EU and UK normally have a 14-day right of withdrawal; by completing the purchase you ask for immediate delivery and acknowledge that you lose that right once delivery has started.

Otherwise, subscription payments for a period that has already started are non-refundable — cancelling stops future charges rather than reversing past ones. If something went wrong with a charge, email dziarkach@gmail.com and we'll look into it.

You can delete your account any time from Settings → Account → Delete account. That permanently removes your account, your live-scoring telemetry, your preferences, your subscription, and any credit balance. It is not reversible. Stripe and Resend keep their own records as required by law.

Some features are labelled beta or "coming later." Those may change, break, or disappear without notice and come with no guarantee of accuracy or availability.

Shot:DNA scores and tracks your practice; it is not a medical device, a personal trainer, or a substitute for a real coach. Train safely and stop if anything hurts.

We may change, suspend, or discontinue parts of the service at any time. We'll do our best to give notice for changes that materially affect paying users. We can terminate your access if you breach these Terms; you can stop using the app any time.

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the app will be uninterrupted, error-free, or that earbud-tap detection will be 100% accurate.

To the maximum extent permitted by law, neither Shot:DNA nor its operator will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the app. Our total liability for any claim related to the service is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) USD 50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, for gross negligence, wilful misconduct, or statutory consumer rights you have where you live).

You agree to indemnify and hold harmless the operator from any claim arising from your misuse of the app, your breach of these Terms, your violation of any law, or your infringement of anyone's rights.

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Prince William County, Virginia, unless a mandatory consumer-protection law in your country of residence requires otherwise. EU and UK consumers retain the right to bring proceedings in the courts of their place of residence.

We may update these Terms from time to time. If a change is material we'll notify you in the app or by email before it takes effect. Continued use after a change means you accept the new Terms.

August 21, 2026: Updated the billing terms to match the plans actually offered — Pro Monthly, Pro Annual, the Founder lifetime pass, the 7-day trial and coach credit packs — and added refund and EU/UK withdrawal rights.
