Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Andrei Dziarkach (sole proprietor), operator of Shot:DNA ("we", "us"). By creating an account or using the service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Shot:DNA.

You must be at least 13 years old to use Shot:DNA. If you live in the European Economic Area, the United Kingdom, or another country where the digital-consent age is higher, you must be at least 16 (or have a parent or legal guardian's permission). By signing up you confirm you meet this requirement.

You are responsible for your account credentials and for everything that happens under your account. Use a strong password and keep it private. Tell us at dziarkach@gmail.com immediately if you suspect unauthorized access.

You agree not to:

• Upload videos of other people without their consent.
• Upload content involving minors who are not your own child or a player you coach.
• Use Shot:DNA to harass, defame or harm anyone.
• Reverse-engineer, scrape, or attempt to extract our models or model weights.
• Circumvent paywalls, rate limits, leaderboard integrity checks, or any security feature.
• Resell, sublicense or otherwise commercially exploit the service without our written permission.
• Upload illegal, infringing or malicious content.

We may suspend or terminate accounts that violate these rules.

You own the videos and content you upload. By uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, process, transform and display that content for the sole purpose of operating Shot:DNA for you — including running our analysis pipeline on third-party compute (see the processors listed in our Privacy Policy).

By default this license also permits us to use your uploaded content to improve our models. You can opt out at any time in Settings → Privacy & data. Opting out applies to future uploads; processing already completed cannot be undone, but no new training will include your content.

We own the Shot:DNA software, models, model weights, designs, game systems, cards, art, and aggregate anonymous statistics derived from the service.

• Shot:DNA offers a free tier with limited analyses and paid plans (monthly, yearly, or one-time passes).
• Paid plans renew automatically until you cancel. Cancel any time from Settings → Subscription; access remains active until the end of the current period.
• New paid plans may include a free trial. If you don't cancel before the trial ends, the plan converts to a paid subscription.
• Credits purchased separately do not expire while your account is active and are non-refundable except where required by law.
• Charges are generally non-refundable, except where required by law. If you believe you were billed in error, email dziarkach@gmail.com within 14 days.
• Prices and features may change. We will give reasonable notice before any change that affects your active subscription.

EU/UK consumers can also use the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.

If you are a consumer resident in the European Economic Area or the United Kingdom, you have the right to withdraw from a paid subscription within 14 days of purchase, without giving any reason.

Immediate performance. By starting to use Shot:DNA (uploading a video, running an analysis, redeeming credits, or any other paid feature) during the 14-day period, you expressly request that we begin performing the service immediately, and you acknowledge that you lose your right of withdrawal once the service has been fully performed.

How to withdraw. Email dziarkach@gmail.com within 14 days of purchase with a clear statement of your decision to withdraw. You may use the model form below:

We will refund any reimbursable amounts within 14 days of receiving your withdrawal notice, using the same payment method you used, unless you ask otherwise. Amounts corresponding to the part of the service already performed at your request may be deducted.

Shot:DNA is an informational and entertainment tool. The metrics, feedback, coaching cards and voice cues are not medical advice and not a substitute for a qualified coach, trainer, physician or physical therapist. Consult a professional before changing your training routine. You assume all risk of injury related to basketball training. Don't shoot through pain.

We work to keep Shot:DNA running, but we don't guarantee uptime. The service is provided "as is" and "as available", without warranties of any kind. We may add, change or remove features at any time.

To the maximum extent permitted by law, neither Andrei Dziarkach nor any affiliate is liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of Shot:DNA. Our total aggregate liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) USD 100.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence or willful misconduct).

You may delete your account at any time from Settings. We may suspend or terminate your account if you violate these Terms or use the service in a way that creates risk for us or other users. Sections that by their nature should survive (ownership, disclaimers, limitations, governing law) will survive termination.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state courts of Prince William County, Virginia, or in the United States District Court for the Eastern District of Virginia. Nothing in this section deprives you of the protection of mandatory consumer-protection law of the country where you reside.

We may update these Terms from time to time. We'll update the effective date at the top of this page and, for material changes, prompt you to re-accept the Terms inside the app. Your continued use after a change means you accept the new Terms.
